Terms of Service
These Terms form a contract between you and Synton.ai LLC, a Wyoming limited liability company doing business as DenyFirst (“DenyFirst,” “we,” or “us”).
Important: DenyFirst performs active security testing. You may submit only systems you own or have explicit authority to test. The service is not a certification, warranty, or substitute for a comprehensive penetration test.
1. Eligibility and account authority
You must be at least 18 and able to enter a binding contract. If you use DenyFirst for an organization, you represent that you can bind it to these Terms. Keep account credentials secure and notify us promptly of suspected compromise.
2. Authorization to scan
You represent and warrant that you own, control, or hold explicit written authorization to test every backend, application, domain, and account you submit. You authorize DenyFirst to perform the bounded tests described in our Security & trust documentation. Provider OAuth, DNS/HTTP challenges, or a countersigned operator attestation may be required before any scan. Passing an ownership check does not excuse a lack of legal authority.
3. Prohibited use
You may not use the service to test third-party systems without permission, evade ownership controls, disrupt availability, obtain data you are not entitled to access, violate law, resell access except under an Agency agreement, or reverse engineer the service beyond rights that cannot legally be restricted. We may refuse or stop any scan that appears unsafe or unauthorized.
4. Service scope and customer responsibility
DenyFirst checks the documented access-control surfaces using bounded probes. Coverage is not exhaustive, results may be incomplete or become stale, and a clean result does not prove that a system is secure. You remain responsible for reviewing findings, protecting systems and data, maintaining backups, and deciding whether and how to apply a suggested fix.
5. Plans, charges, and renewal
- Your first eligible scan is free.
- If that scan reports an exposure and you then activate a plan, the price displayed at authorization is charged and a recurring subscription begins.
- If the free scan is clean, no subscription begins and the card is not charged.
- Monthly plans renew monthly. Annual plans are charged in full for one year and renew yearly. Renewal continues regardless of the outcome of later scans until canceled.
- Prices are in US dollars, exclude applicable taxes, and are processed by Stripe.
The checkout shows the exact amount charged today and the renewal interval before you authorize payment.
6. Cancellation, refunds, and account closure
You may cancel renewal from Billing at any time. Cancellation normally takes effect at the end of the paid period and does not refund amounts already paid. Account closure is different: it immediately revokes access and scanning authority, stops billing, and begins deletion subject to legal retention. We will correct duplicate or erroneous charges; contact hello@denyfirst.com.
7. Customer data and privacy
You retain rights in data you submit. You grant us the limited rights needed to host account information, verify ownership, perform requested scans, create reports, prevent abuse, and support the service. Our Privacy Policy describes processing, retention, analytics choices, and subprocessors.
8. Intellectual property and feedback
DenyFirst and its software, checks, documentation, and branding belong to Synton.ai LLC or its licensors. You may use reports internally and share them with your professional advisers and customers. Feedback may be used without restriction or payment, without identifying you publicly.
9. Confidentiality
Each party will protect the other's non-public information using reasonable care and use it only to perform or receive the service. This does not cover information already known without restriction, independently developed, lawfully received, public through no breach, or required to be disclosed by law.
10. Suspension and termination
We may suspend access for suspected unauthorized scanning, security risk, non-payment, or material breach. We will use reasonable efforts to give notice when doing so would not increase risk. Either party may terminate as allowed by these Terms; provisions that should survive termination do so.
11. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and detection of every vulnerability. Nothing excludes warranties or rights that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, revenue, goodwill, or data. Our aggregate liability arising from the service will not exceed the greater of US$100 or the fees you paid us during the twelve months before the event giving rise to liability. These limits do not apply where prohibited by law or to fraud, willful misconduct, or your unauthorized use of third-party systems.
13. Indemnity
You will defend and indemnify Synton.ai LLC against third-party claims arising from a system you submitted without authority, your unlawful use of the service, or your material breach of these Terms, except to the extent caused by our own breach or misconduct.
14. Governing law and disputes
Wyoming law governs these Terms without regard to conflict-of-law rules. Courts located in Sheridan County, Wyoming have exclusive jurisdiction, unless applicable consumer law gives you the right to bring a claim elsewhere. Before filing, each party will attempt in good faith for 30 days to resolve the dispute through written notice.
15. Changes and general terms
We may update these Terms prospectively. Material changes will be announced in the service or by email, and we will request new acceptance when appropriate. Neither party may assign these Terms without consent, except in connection with a merger, acquisition, or sale of substantially all assets. If a provision is unenforceable, the rest remains effective. These Terms and the referenced policies are the entire agreement for self-serve use.
